Unfortunately, the 10th Circuit opinion continues to allow the IRS to exploit a procedural loophole to deprive churches of their constitutional protections through the balance achieved in federal law under the Church Audit Procedure Act.

Even the Court acknowledged the danger here by conceding the Magistrate's determination that, '[The] argument that this arrangement allows [IRS] to essentially bypass . . . safeguards afforded to churches under § 7611 is one to be taken up in the halls of Congress, not a courtroom.'

If courts will not stop this procedural abuse by the IRS, Congress must act to close this loophole that essentially swallows the Church Audit Procedure Act. While our client is steadfastly committed to continuing the fight for religious liberties, we will review this opinion with our client and proceed as we deem advisable."

Pastor Rick & Pennie Statement on the IRS:

The IRS harasses God’s Storehouse Church and Pastor after Freedom From Religion Foundation (FFRF) demanded they investigate it based on untrue accusations and misinformation after Pastor Rick Kloos wins a senate seat.

Acting on the demand of this atheist group the IRS is now bypassing our rights and protections as a Church.

After voluntarily giving the IRS 19, in-depth documents, within the scope of the inquiry, and over a year of answering all their requests, they still refuse to meet with our board. They continue to question the legitimacy of our Church and our Pastors.

After much bullying for information we now realize they aren’t wanting to work with us to find a resolve, but are on a fishing expedition to discredit us as a Church. We no longer trust the intentions of this inquiry.

Therefore, we have decided as a board to fight the IRS for our rights as a Church. All the news articles that have mounted against our Church, due to the unsubstantiated false claims of the FFRF and the IRS, have not only cost our small Church a surmounting amount in legal fees, but also puts our credibility and reputation in question in the public’s eye. The disinformation attempts to hurt our community endeavors as a valid Church.

This governmental overreach and public harassment could have been avoided had the IRS been willing to visit with our board and Church on site. It only confirms that their intent was to discredit and undermine our Church ministry due to the quest of an atheist organization that has an agenda of hate towards Churches.

For this reason the IRS needs reform within its own agency because they have circumvented the Church procedural act. It is necessary in order to prevent further harassment of other Churches.

If we allow them to do this to our Church they will continue to do it to other Churches. With 87,000 IRS agents being added we must keep the IRS in check and accountable.

Further thoughts: - Should pastors and Church leaders who run for office expect their Church to be audited? - Why is the IRS acting on the demands of an atheist group and bypassing our rights as a Church. After we had clearly resolved any questions or concerns they pressed to try to find something else to question. They don’t want a resolve. They are being weaponized against the Church.
